Permit-by-Rule
A Permit-by-Rule establishes pre-determined operational limitations for certain industrial categories for the purposes of ensuring that a facility will not be considered a major source with respect to Title V of the Clean Air Act Amendments of 1990. A SIP construction/operating permit is still required.
A Permit-by-Rule application/permit is appropriate for potentially major sources that are able to operate under limits outlined in Georgia Rules for Air Quality Control 391-3-1-.03(11). A facility accepting a Permit-by-Rule is not exempt from the obligation to apply for and obtain a Construction (SIP) Permit and/or an Operating (SIP) Permit. Complying with the requirements of a Permit-by-Rule does not relieve a facility of having to comply with other requirements of the Georgia Rules for Air Quality.
The following Permit-by-Rules are currently available:
- Fuel-burning equipment burning natural gas/LPG and/or distillate oil
- Fuel-burning equipment burning natural gas/LPG and/or residual oil
- On-Site Power Generation
- Concrete and concrete products
- New asphalt plants (which commenced construction or modification after June 11,1973) permitted to burn natural gas/LPG and/or distillate oil
- New and existing asphalt plants permitted to burn natural gas/LPG, distillate oil, and residual oil in any combination
- New asphalt plants (which commenced construction or modification after June 11,1973) permitted to burn natural gas/LPG and/or distillate oil only, which are located in the Atlanta ozone non-attainment area*.
- New and existing asphalt plants permitted to burn natural gas/LPG, distillate oil, and residual oil in any combination, which are located in the Atlanta ozone non-attainment area*.
- Cotton ginning operations
- Coating and/or gluing operations - 20,000 pounds per 12 consecutive month limit
- Coating and/or gluing operations - 250 gallons per month limit
- Coating and/or gluing operations - 3,000 gallons per rolling 12-month period limit
- Coating and/or gluing operations - tons of HAP and VOC usage limits
- Printing Operations
- Non-reactive mixing operations
- Fiberglass molding and forming operations
- Peanut / Nut shelling operations
