On September 14, 2020, EPD notified stakeholders that in order to clarify that surface mine applications meet the requirements of O.C.G.A.12-4-75(2) which states, "To submit, with the application for a permit, a mining land use plan which shall be consistent with the land use in the area of the mine....", EPD has updated Section III. General Mining Information of the permit application. This change will be applied to all surface mine applications currently in-house at EPD and all future applications. Please see the  Download this pdf file. MLUP guidance for more details.

Effective July 1, 2024, all surface mines will have a set financial assurance requirement of $2,500 per acre. Applications submitted on or after July 1, 2024 for new permits or amendments requesting additional acreage will be subject to the $2,500 per acre financial assurance requirement. Surface mines currently exempt from financial assurance will remain exempt, and acreage under existing permits will remain at their current financial assurance per acre amount.
